This case study outlines how BWL’s expert Technical Services Team helped with commercial management and quantity surveying to support Bartlett Contractors with a dispute which had arisen during an infrastructure project at a new fuel depot.

Scope of works

The Technical Services Team at BWL provided commercial management and quantity surveying to support Bartlett Contractors with a dispute that arose during an infrastructure project at a new fuel depot.

As part of this process, the BWL’s team drew upon its quantum and delay expertise to support the business by substantiating contract variations.

During negotiations with the project client, it was clear that a dispute had arisen between the parties regarding the merits of variations, delay and interim account valuation.

While working closely with the commercial team at Bartlett Contractors, BWL’s Quantity Surveyors supported the client to align its position ready for adjudication. This included preparing all documents for the adjudication, including detailed witness statements and substantiation of variations. Collaboratively, the team then worked with BWL’s Solicitors who acted on behalf of Bartlett Contractors throughout the adjudication. Due to the robust case which was presented by BWL, the parties agreed to an interim settlement while the adjudication was underway. The interim settlement allowed the works to continue on-site with both parties satisfied with the outcome.

BWL’s commercial team supported Bartlett Contractors to navigate its way through the last months of the project while preparing for final account negotiations. This meant that as and when other issues arose BWL Group was already fully immersed in the contract and its intricacies so that issues could be addressed promptly to allow Bartlett Contractors to continue with the remaining parts of the project.

As the team included both Chartered Civil Engineers and Quantity Surveyors, they were familiar with the intricacies of infrastructure projects which allowed them to support the client in the most effective way.
